RENTAL AGREEMENT AND TERMS
This Rental Agreement (“Agreement”) is entered into as of the date of execution below, by and between Hamelin Ventures, LLC d/b/a Hammers Rentals (“Lessor,” hereinafter referred to as Hammers Rentals) and the undersigned (“Lessee”).
1. Rental Period
The rental period begins on the date and time of pickup/delivery and ends when the equipment is returned to Hammers Rentals.
Late returns will be charged at the daily rental rate unless otherwise agreed in writing.
All extensions of the rental period must be approved by Hammers Rentals in advance.
2. Payment & Security Deposit
A security deposit of $50.00 (or such other amount as determined by Hammers Rentals based on the equipment rented) is required at the time of reservation to secure the rental date. The deposit is separate from the rental fee and will be refunded to Lessee after the equipment is returned and inspected, less any authorized deductions.
The full rental fee is due at the time of delivery or pickup of the equipment, prior to release of the equipment to Lessee.
Deductions may be made from the security deposit for additional fuel used, cleaning fees if equipment is returned excessively dirty, repair of damage beyond normal wear and tear, replacement of missing or damaged accessories, attachments, or manuals, and late return charges or other unpaid fees under this Agreement.
Any remaining deposit balance, after deductions if applicable, will be refunded within 1–3 business days. Lessee acknowledges that actual receipt of funds may take longer depending on payment processing times of the issuing bank, credit card company, or third-party processor (e.g., Stripe).
3. Condition of Equipment
Lessee acknowledges receipt of equipment in good working order.
Lessee is responsible for returning equipment in similar condition, subject to reasonable wear and tear.
Charges may apply for repairs resulting from damage due to improper use, negligence, or the use of incorrect fuel. Only the fuel provided or specified by Hammers Rentals may be used in the equipment.
4. Loss, Theft, or Damage
Lessee assumes full responsibility for the loss, theft, or damage of rented equipment, regardless of cause, and agrees to pay repair or replacement costs.
Replacement costs will be based on the current retail value of the equipment.
Charges also apply for lost or damaged accessories, attachments, manuals, or safety equipment.
5. Use of Equipment
Equipment must only be used for its intended purpose and solely by the Lessee agreeing to these terms.
The Lessee may not permit family members, friends, or any other third party to operate or use the equipment under any circumstances.
Lessee shall not modify, disassemble, or misuse the equipment.
Unauthorized lending, sub-renting, or transfer of equipment is prohibited.
6. Liability & Indemnification
Lessee accepts all risks associated with use of the equipment.
Hammers Rentals shall not be held liable for injuries, property damage, loss of time, loss of profits, or any incidental or consequential damages arising from use of equipment.
Lessee agrees to indemnify and hold harmless Hammers Rentals from any and all claims, liabilities, damages, or costs (including attorney’s fees) related to use or possession of the equipment.
7. Cancellations
Reservations may be canceled at least 24 hours in advance for a full refund.
Same-day cancellations may be charged up to 50% of the rental fee.
8. Failure to Return Equipment
If equipment is not returned within 7 days of the agreed return date, Hammers Rentals reserves the right to report the equipment as stolen under Pennsylvania law.
Lessee agrees that Hammers Rentals may repossess equipment at any time, without notice or legal process, if it is being used in violation of this Agreement, appears abandoned, or is not returned when due.
9. Delivery & Pickup
If delivery/pickup service is provided, Lessee must ensure safe access to the location.
Additional fees may apply for failed deliveries or pickups due to inaccessible sites.
10. Collection & Attorney’s Fees
In the event of non-payment, loss, theft, or breach of this Agreement, Lessee shall be responsible for all costs of collection, including reasonable attorney’s fees and court costs.
11. Governing Law
This Agreement is governed by the laws of the Commonwealth of Pennsylvania.
